E-mail: mtzcfrancisco gmail. The right to self-determination has become an increasing legitimate demand of peoples seeking recognition and autonomy. In the beginning, this right was conceived in favor of peoples that depended on colonial powers, but today it has become a claim of any people that considers itself a people, as in the case of indigenous peoples or non-colonized peoples. This concept of the right to self-determination seems to be the path leading to a more heterogeneous world. Conversely, the rise of various problems that affect us globally seems to require the creation of international political institutions capable of solving these problems, which would most likely lead us toward a more homogeneous global order.

In doing so, the work directs particular attention to the right to self-determination including to what might be the content and scope of this right when applied not to aggregate populations of states but to segments of states such as indigenous peoples. Second, the book discusses the correct understanding of equality under contemporary international law and asserts that this right underpins a substantial number of the rights that make up the indigenous rights discourse. It infers that the content and scope of such rights follow directly from a correct understanding of equality. Indigenous Peoples' Status in the International Legal System
Indigenous rights are those rights that exist in recognition of the specific condition of the indigenous peoples. This includes not only the most basic human rights of physical survival and integrity, but also the rights over their land including native title , language , religion , and other elements of cultural heritage that are a part of their existence and identity as a people. This can be used as an expression for advocacy of social organizations, or form a part of the national law in establishing the relation between a government and the right of self-determination among its indigenous people, or in international law as a protection against violation of indigenous rights by actions of governments or groups of private interests. Indigenous rights belong to those who, being indigenous peoples, are defined by being the original people of a land that has been conquered and colonized by outsiders.
Wiggins to discuss his journey as an Indigenous leader and human rights defender. Due to his human rights work in La Moskitia, he was arrested both during the Somoza and Sandinista regimes and was taken as a political prisoner. In , the political situation in Nicaragua forced him into exile.
Indigenous rights are arguably the most successfully institutionalized form of minority rights in international law today. Currently, Indigenous rights provide greater protections particularly where the control of territory and self-government are concerned than more general minority rights. This creates clear incentives for historically subordinated minority groups to assert Indigenous status. The proliferation of claims to indigeneity has led to debates about whether the category should be expanded to include some minority groups who now fall outside it or whether a more restricted conception of indigeneity should continue to prevail.
From to , the Iroquois Confederacy — a federal union of six aboriginal nations — sought resolution of a dispute between themselves and Canada at the League of Nations. In this paper, the historical events of the s League are employed as a case study to explore the development of the international society of states in the early 20th century as it relates to the indigenous peoples of North America. Specifically, it will be argued that the early modern practice of excluding Amerindians from international political forums is related to the negative representation of indigenous peoples in the dominant theoretical discourse of the time: social contract theory.
Indigenous rights have been gaining traction in international law since World War II, as the indigenous peoples, previously classified under the scope of domestic law, have propelled their cause into the global arena. Indigenous societies are vastly heterogeneous, but they possess some common features, such as lack of statehood, economic and political marginalization, and cultural and racial discrimination. Scholars generally agree that one of the most important goals of the international indigenous movement is to advance indigenous rights under international law. Hence, there have since been several international institutions that seek to address indigenous rights. However, the majority of the indigenous rights scholarship only examines the policy on indigenous rights, rather than the broader contexts of indigenous rights or the rise of indigenous rights as a phenomenon.
